Biden Pardons Thousands of Veterans Convicted Under Anti-Gay Military Law

President Joe Biden has issued a proclamation pardoning thousands of U.S. veterans who were convicted under a military law that banned gay sex, making them eligible for previously withheld benefits. This move, announced early Wednesday, seeks to “right an historic wrong” and pardon former service members “who were convicted simply for being themselves,” according to Biden.

Historic Military Ban Lifted

For over six decades, the Uniform Code of Military Justice Article 125 criminalized consensual sodomy. This law was in place until Congress amended it in 2013, following the repeal of the “don’t ask, don’t tell” policy. Biden emphasized the injustice faced by thousands of LGBTQI+ service members who were forced out of the military due to their sexual orientation or gender identity, often facing court-martial and lifelong stigmatization.

Automatic Pardons and Access to Benefits

Affected veterans will automatically receive a pardon. However, to access care and previously withheld benefits, veterans must provide proof of eligibility, as explained by a senior administration official. With a certificate of pardon, veterans can apply to have their discharge characterization changed. Detailed procedures will be available on the Defense Department website, and the Justice Department will assist in disseminating this information to veterans.

Addressing a Long-Standing Injustice

The Biden administration estimates that thousands were convicted under Article 125 before its revision. While officials have not specified how many might seek benefits or the duration of the application process, the administration acknowledges the challenge of reaching veterans experiencing homelessness. This action follows Biden’s earlier sweeping pardon for Americans with marijuana convictions.

Biden reiterated his commitment to maintaining a respectful and inclusive military, stating, “This is about dignity, decency, and ensuring the culture of our Armed Forces reflects the values that make us an exceptional nation.” This proclamation underscores Biden’s broader efforts to ensure every member of the military is safe and respected.
